Terms and Conditions
Last updated: 18 October 2026
- You can cancel any pack within 14 days and get back every hour you haven’t used.
- The 48-hour and 96-hour packs include a speaking-goal guarantee, with clear conditions.
- Spanish and EU law apply. Students in the UK, the US or elsewhere keep their local consumer rights (section 14).
1.Who we are
The Native Method offers online 1:1 Spanish lessons. Provider: Verónica Gutiérrez, trading as The Native Method, NIF [NIF/DNI], [street address], 28019 Madrid, Spain.
Website: www.thenativemethod.com. Contact: info@thenativemethod.com.
These Terms and Conditions govern your use of our website and everything you buy from us. By booking or paying, you accept them. “Consumer” means an individual who buys for personal use. “Business client” means a company or professional who buys for work. “Student” means anyone taking lessons.
2.Services
- 1:1 General Spanish — private online lessons in packs of 1, 12, 24, 48 or 96 hours.
- 1:1 Business Spanish — private online lessons focused on Spanish for work, for individuals and teams, with a pilot programme and a shared hours pool (section 5).
Lessons are live on Zoom or Google Meet. Classes last one hour, any day between 08:00 and 20:00 Madrid time, and are given by Verónica Gutiérrez or other teachers of The Native Method. Packs of 12 hours or more include Campus access to replay your lessons.
The free level test, trial lesson and 30-minute session are free and carry no obligation. We may limit them to one per person. What each pack includes is what the pricing page says when you buy, and forms part of your contract.
3.Enrolment and eligibility
- Our method is designed for adults. You must be 18 or older, or have reached the legal age of majority where you live. We don’t teach children.
- To buy, you choose a pack, give your details, review the summary and total price, and press the button that says you must pay. Your place is confirmed when we send you a confirmation email. You can fix any mistake before paying, or write to us afterwards. We keep the contract and send you a copy by email.
- We may assess your level to tailor your plan. If the pack you chose doesn’t match your goals, we will recommend the most suitable option.
- Lessons are subject to teacher availability.
4.Pricing and payment
- Prices are in euros and include any taxes that apply, unless we say otherwise. Business clients get an invoice.
- Payments are processed by Stripe and PayPal. We never store your card details. Your bank may charge currency conversion or foreign transaction fees.
- You can pay in full or, for packs of 12 hours or more, in 3 equal instalments when offered at checkout. If an instalment fails, we may pause your classes until it is paid. The remaining instalments are due unless you cancel under section 5.
- Promo codes apply only to the packs and dates shown, can’t be combined and have no cash value. Refunds use the price you actually paid.
- We may change our prices. A change never affects a purchase you have already confirmed and paid.
5.Cancellation and refunds
14-day right to cancel
If you are a consumer, you can withdraw from your purchase within 14 calendar days of the contract, without giving a reason (Royal Legislative Decree 1/2007, arts. 102 ff., and Directive 2011/83/EU). We give the same right to every individual student, wherever you live.
To withdraw, use the withdrawal button on this website, or email info@thenativemethod.com with your name and the email you booked with. It is enough to send your notice before the 14 days end. We refund everything you haven’t used, to the payment method you paid with, within 14 days of your notice. You pay only for the hours you used, at the hourly rate you paid. This is the same for every pack, with or without a promo code. If you pay in instalments, we cancel the remaining ones. If you have taken all your hours, there is nothing to refund.
After 14 days
Packs aren’t refundable after the 14 days, except as these Terms or the law provide. Hours are valid for [12 months] from purchase ([18 months] for the 96-hour pack). Unused hours then expire, without affecting your legal rights. If you have a good reason, such as illness, ask us before they expire and we will consider extending them.
Cancellation by The Native Method
If we cancel a class or a service for reasons within our control, we reschedule it or refund the hours at no cost to you.
Business clients
Business clients have no legal right of withdrawal. Their terms: Pilot (24 hours per person) — each person has a level check (CEFR) in the first and last class, and your manager gets a monthly progress report. After a person’s first 2 classes, if it isn’t a fit, you pay only for the hours used. Moving up — within 60 days of the last pilot class, you can move to a longer plan or the shared pool. Hours already taken count, and you pay the new plan’s price minus the pilot price for the remaining hours. Shared pool — 200 hours shared by your team, valid for 12 months, on one invoice paid upfront. We confirm a personalised quote within 24 hours. You confirm you may give us your team’s details and have told them how we use them (see our Privacy Policy).
6.Our guarantee
Speaking-goal guarantee for the 48-hour and 96-hour packs. In class 1, you and your teacher write one speaking goal. After your first 48 hours, we check it together. If you haven’t reached it, we add up to 8 free hours and check again.
- A second teacher runs a 15-minute conversation, recorded only for this check, and scores it against your goal with a rubric you see beforehand.
- You must have attended at least 90% of the classes you booked, done the practice your teacher set and used your first 48 hours within 9 months.
- The guarantee adds lessons. It doesn’t refund money. It isn’t a promise of an exam result or a CEFR level, and it ends if you cancel the pack.
7.Rescheduling and absences
- You can reschedule a class for free if you tell us at least [24 hours] before it starts.
- With less notice, or if you don’t show up, the class counts as taken. We may make an exception for illness or an emergency.
- If you are late, the class still ends at the scheduled time.
- If we cancel, or a technical problem on our side stops the class, we reschedule it at a time that suits you.
- You can pause your lessons for up to 60 days for personal reasons. Ask us in writing at info@thenativemethod.com, and your hours stay valid for the same period. For a longer pause, we agree it in writing.
8.Student conduct
Please be on time, prepared and respectful with your teacher. Don’t record, copy or share lessons or materials without our written consent. In serious cases, such as abuse, harassment or fraud, we may end the lessons without refunding unused hours. Otherwise, if we end the service, we refund the hours you haven’t used.
9.Intellectual property
The method, lesson materials, website and the name “The Native Method” belong to us or our licensors. While your hours are valid, you may use the materials for your own learning (or, for Business clients, internally). You may not copy, distribute, share your access with others or use them commercially without our written consent.
10.Recordings
We record lessons so you can replay them on the Campus. Only you and your teacher can see them, and we never publish them or share them with third parties. The speaking-goal check is recorded separately and only for that check. If you don’t want to be recorded, tell us before class and you will have no replay. How we store recordings is in our Privacy Policy.
11.Limitation of liability
We teach Spanish, and learning depends on your effort. Apart from the guarantee in section 6, we don’t promise a CEFR level, an exam result, a job or a date. Estimates of how long a pack takes are examples based on 1-hour classes.
Nothing here limits liability that the law doesn’t allow us to limit, such as fraud, wilful misconduct, death or personal injury, or your rights as a consumer. Beyond that, we are liable for foreseeable damage caused by our fault. For Business clients, our liability is limited to the amount paid for the service in the 12 months before the claim. We aren’t responsible for failures of Zoom, Google Meet or your internet beyond rescheduling under section 7.
12.Force majeure
If something beyond our reasonable control stops us from teaching (for example a natural disaster, a pandemic, government restrictions or an internet infrastructure failure), we are not in breach of these Terms. We will make reasonable efforts to reschedule the affected classes at no cost to you.
13.Governing law and disputes
These Terms are governed by Spanish law and applicable EU law, including Directive 2011/83/EU on consumer rights. The mandatory consumer protections of your country of residence continue to apply. For Business clients, the courts of Madrid, Spain, are competent.
If you’re not happy, write to info@thenativemethod.com first. Tell us what you need and we will do everything we can to help you reach your goals with the language. With a 48-hour or 96-hour pack, you can also use the speaking-goal guarantee (section 6). We answer as soon as possible and within the legal deadlines. Consumers can also contact their local consumer authority (in Spain, the OMIC or the regional consumer office) or the European Consumer Centres Network. The EU’s online dispute resolution platform closed on 20 July 2025. [We are not currently adhered to any out-of-court consumer dispute body]
14.Consumer rights and students outside Spain
- EU and EEA: the mandatory consumer rules of your country of residence still protect you.
- United Kingdom: your 14-day right in section 5 applies, and so do consumer rights you can’t waive.
- United States and elsewhere: your contract is with a provider based in Spain and is governed by Spanish law and applicable EU law. Sections 5 and 6 apply to you in full. Prices are in euros, so your bank may add currency conversion fees. We don’t charge local sales tax or other countries’ VAT unless the law requires it. Class times are in Madrid time. Your personal data is processed in Spain and you keep the rights in our Privacy Policy.
To withdraw you can also send this text to info@thenativemethod.com: “To The Native Method, [street address], 28019 Madrid, Spain: I withdraw from my contract for the following service: [pack]. Ordered on: 2026. Name: [your name]. Email used to book: [your email]. Date: 2026.”
15.Changes to these terms
We may update these Terms. The new version applies to purchases made after the date at the top. We will tell you about significant changes by email or with a notice on our website. Purchases already made stay under the Terms in force when you bought. These Terms are in English, and any translation is only for convenience.
